واکاوی حقوقی انتقال فناوری‌های نوین با تأکید بر تعامل نظام‌های حقوقی ملی و بین‌المللی

چکیده
با ظهور شتابان فناوری‌های نوظهور، از نانوفناوری تا هوش مصنوعی و زیست‌فناوری، انتقال دانش و تخصص نهفته در آن‌ها به اقصی نقاط جهان، دیگر یک انتخاب نیست، بلکه یک ضرورت حیاتی برای پیشبرد مرزهای دانش و شکوفایی اقتصادی ملت‌ها محسوب می‌شود. این فرایند، که فراتر از جابه‌جایی صِرف تجهیزات یا اطلاعات فنی است، نیازمند یک بستر حقوقی استوار و هماهنگ در سطوح ملی و بین‌المللی است تا به‌درستی شکل بگیرد و به اهداف خود دست یابد. دراین‌راستا، این نوشتار در نظر دارد تا ضمن کاوش در مفاهیم بنیادین انتقال فناوری، به واکاوی قواعد حقوقی حاکم بر این مهم در اسناد بین‌المللی برجسته‌ای چون موافقت‌نامه TRIPS و ساختارهای کارآمد کشورهای پیشرو بپردازد. همچنین در این تحقیق، نگاهی دقیق به چارچوب‌های قانونی و نهادی موجود در نظام حقوقی جمهوری اسلامی ایران در حوزة انتقال فناوری خواهیم داشت و با تطبیق آن‌ها با الگوهای موفق جهانی، نقاط قوت و ضعف آن‌ها را شناسایی کرده و نیازمندی‌های اصلاحی را موردبحث قرار خواهیم داد. هدف غایی این پژوهش، ترسیم یک تصویر روشن از وضعیت حقوقی انتقال فناوری‌های نوین در جهان و ایران است. امید است که نتایج این بررسی بتواند راهکارهایی عملی برای ارتقا و تقویت زیرساخت‌های قانونی و اجرایی این فرایند کلیدی در کشور عزیزمان ارائه دهد.

Legal Analysis of Emerging Technology Transfer with Emphasis on the Interaction of National and International Legal Systems

چکیده English

With the rapid emergence of cutting-edge technologies, including nanotechnology, artificial intelligence, and biotechnology, the transfer of embedded knowledge and expertise across the globe is no longer optional but a vital necessity for advancing the frontiers of science and ensuring the economic prosperity of nations. This process, which goes far beyond the mere exchange of equipment or technical information, requires a solid and harmonized legal framework at both national and international levels to be effectively realized. This study aims to explore the fundamental concepts of technology transfer while analyzing the legal norms governing this process, as reflected in key international instruments such as the TRIPS Agreement and the institutional structures of leading countries. Furthermore, it closely examines the existing legal and institutional frameworks within the legal system of the Islamic Republic of Iran regarding technology transfer, comparing them with successful global models to identify strengths, weaknesses, and areas in need of reform. The ultimate goal of this research is to provide a clear understanding of the legal landscape surrounding the transfer of emerging technologies in both global and Iranian contexts. It is hoped that the findings will offer practical solutions for strengthening the legal and operational infrastructure essential to this critical process in our country.
